This Privacy Policy explains how TheBrain Technologies LP ("TheBrain," "we," or "us") collects, uses, shares, and protects your information across our website, software, and optional online services — including cloud sync, sharing, backup, and AI features such as Cerebro (collectively, the "Services"). It applies alongside our Terms of Use and the End-User License Agreement that governs the software and Services, available at thebrain.com/eula.
Information we collect
- You provide: account details (name, email, password) and messages you send us.
- Billing: when you subscribe or make a purchase, you enter payment details — credit card number, expiration date, and billing address — on our website; we submit them to our payment processor to complete the transaction and do not store your full card number.
- Your content: the brains, thoughts, notes, links, and file attachments you choose to sync, share, or back up.
- AI inputs: the content you submit to AI features such as Cerebro.
- Automatically: usage and diagnostic data (e.g., software version, install age, feature-usage statistics), limited device/browser information, and website cookies.
How we use it
To provide, secure, maintain, and improve the software and Services; process subscriptions and send transactional and service messages; provide the AI features you use; respond to support and — with your choices — send product news; prevent fraud, abuse, and security issues; and comply with law. We do not sell your personal information, and we do not use the private content you sync to advertise to you.
Your content and AI features
Your synced content is yours. We process it only to provide the Cloud Services you use; we don't make private brains public, and shared or published content is visible only to the people and audiences you choose. When you use an AI feature such as Cerebro, the content you submit may be processed by TheBrain and trusted third-party AI providers acting on our behalf, solely to provide that feature and under confidentiality and data-protection obligations. AI features are optional.
How we share information
Only with service providers and sub-processors that help us run the Services (e.g., cloud hosting, AI processing, payment processing, analytics, and support) under contracts that require them to protect your information and use it only on our instructions; when required by law or to protect rights and safety; in connection with a business transfer; and with others when you choose to share or publish a brain. We do not sell your personal information.
Retention and deletion
We keep your information while your account is active or as needed to provide the Services. Deleted content is removed from active systems and purged from backups within a reasonable period; when you close your account we delete or anonymize your information and content, except where we must retain certain information to meet legal obligations, resolve disputes, or enforce our agreements.
Your rights
Depending on where you live, you may access, correct, export, or delete your personal data and object to or restrict certain processing. You can manage much of this in the app or your account settings, or contact privacy@thebrain.com; we respond as required by law and will not discriminate against you for exercising your rights.
Security
We use administrative, technical, and physical safeguards, including encryption of data — such as the payment-card information you submit — in transit, and appropriate protections for data at rest. No system is completely secure, so we cannot guarantee absolute security. We recommend choosing a strong, unique password and keeping it confidential.
Cookies, marketing, and choices
Our website uses cookies to remember your preferences and understand usage, and we may use "remarketing" so vendors such as Google can show relevant ads based on your prior visits (opt out at Google's Ads Settings); you can also manage cookies in your browser. You may opt out of promotional email at any time via the unsubscribe link or your account settings — we may still send necessary service messages.
Other
The Services are not directed to children under 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect their information. We and our service providers may process information in the United States and other countries, with appropriate safeguards for international transfers where required. We may update this policy from time to time and will post changes here with a new "Last updated" date.
